ARTICLE 2 PURPOSE OF THE CONTRACT
The purpose of these General Terms and Conditions of Sale for the Website is to define the contractual relationship between the Customer and La Poste. These General Terms and Conditions of Sale for the Website apply to any purchase made on the Website (see the terms for accepting these General Terms and Conditions of Sale set forth in Article 4 below).
The Products available on the Site are intended exclusively for customers residing outside metropolitan France (including Corsica) and the overseas departments and territories (DROM-COM). More specifically, the Products are sold for pickup.
For the avoidance of doubt, it is specified thatexcept for the mailing of postal items from mainland France (including Corsica) and the French overseas departments and territories(DROM-COM), the postage products sold on the Website may under no circumstances be used for domestic, international, or foreign mailings. In the event that postage products sold on the Website are used from metropolitan France (including Corsica), the Customer is informed that the current general terms and conditions of sale applicable to La Poste’s Mail and Parcel services will apply to them. ARTICLE 3 DEFINITIONS
"Email address":&refers to the email address used as the Customer’s account identifier with La Poste when creating an account on the Website and to which the Customer will receive, in particular, the registration confirmation email and any subsequent notifications (alerts, acknowledgments of receipt, etc.).
"Customer" : refers to any individual who purchases Products on the Website.
"Account": : refers to the La Poste account opened by a Customer, allowing the Customer to log in (by entering their email address and password), access a Customer Area, and purchase Products on the Website. This account consists of the Username, Password, and all of the Customer’s personal data and preferences.
"Customer Area" : refers to the personal online space reserved for the Customer, allowing them to manage their account, personal data, and preferences; track their orders; and retrieve their invoices—all via the Website.
"Username" : refers to the email address chosen by the Customer to log in and access the Website.
"Login" : refers to the procedure used to uniquely identify the Customer.
""Password" : refers to the confidential code provided by the Customer which, when combined with a Username, allows the Customer to access their Account. The password is a sequence of characters entered by the Customer, which then constitutes their personal, exclusive, and confidential code. It consists of at least eight (8) characters, including at least one letter and one number.
"Products" : refers to all physical products that can be ordered on the Website.
"Website" : refers to the website published and operated by La Poste, accessible in particular via the URL www.francestampphilatelystore.laposte.fr and which allows Customers to purchase Products online.
"T&C" refers to these Terms and Conditions of Sale (also referred to as the Agreement) for the Website (including any document expressly incorporated herein by reference), any special terms and conditions specified by La Poste, and any amendments thereto.
ARTICLE 4 TERMS AND CONDITIONS OF USE - ACCEPTANCE OF THE GTC AND OPERATION OF THE WEBSITE
4.1 Access to the Website - Availability
Except in cases of force majeure as referred to in Article 14 below and during maintenance periods, La Poste will use its best efforts to ensure the Site’s availability and accessibility 24 hours a day, 7 days a week.
All equipment, communication fees, and other costs and expenses necessary to connect to, access, and use the Website in order to view and purchase Products are and shall remain the responsibility of the Customer.
Each Customer agrees not to interfere with the proper functioning of the Website in any way, including by transmitting any material that may contain a virus or that may damage or affect the Website and, more generally, the information systems of La Poste and/or its partners’ information systems. Each Customer acknowledges that they are familiar with and understand the Internet and its limitations, including its functional characteristics and technical performance, the risks of interruption, response times for reading, retrieving, or transmitting information, and the risks, of any kind, inherent in any data transmission, particularly over open networks.
La Poste cannot be held liable for any errors or damage that may occur during the transmission of information, when such events result from third-party networks or from a failure or negligence on the part of the Customer.
4.2 Creating an Account
An Account is required to make a purchase on the Website.
The Customer will be prompted to create an Account on the Website when placing their first order.
The Customer agrees to provide accurate and up-to-date information when creating their Account. Thus, the Customer alone is responsible for any consequences resulting from inaccurate information. The Customer can access and modify their personal information by logging into their personal account and going to the “Profile” section.
A Customer who already has an Account must log in using their Username and Password. If the Customer becomes aware of any unauthorized use of their Account, they must notify La Poste as soon as possible.
4.3 Acceptance of these General Terms and Conditions of Sale
Acceptance of these General Terms and Conditions of Sale is a mandatory prerequisite. For the Customer, acceptance occurs upon reading these General Terms and Conditions of Sale, as presented to the Customer, and by checking a box to confirm acceptance of the General Terms and Conditions of Sale when purchasing a Product on the Website.
La Poste reserves the right tomake changes to the Website and the Products at any time and, consequently, to these General Terms and Conditions of Sale. The Customer will be required to accept the new General Terms and Conditions of Sale if they wish to continue making purchases on the Website. Changes made to the Website, the Products, and/or these General Terms and Conditions of Sale, if any, do not apply to Product orders that were confirmed prior to the effective date of such changes.
ARTICLE 5 ORDERS - PRICES - PAYMENT
5.1 Orders
The maximum value of a shopping cart is one thousand five hundred euros (€1,500).
If a Customer wishes to make a purchase on the Website, they must select the Products and add them to the shopping cart.
Products are sold on the Website while supplies last, provided that (i) the Website will indicate if certain Products are out of stock (for example, certain Products may be limited editions and will be sold while supplies last) and (ii) certain Products may be purchased in limited quantities per order, as indicated on the Website.
Once the Products have been selected, the Customer may confirm the contents of their shopping cart and finalize their order. The order will not be registered until the final confirmation on the order summary page.
In accordance with the double-click method, the Customer’s consent is confirmed by clicking on the order confirmation.
At this stage, the Customer is redirected to a page prompting them to enter their contact information. To complete the order, the Customer must pay the order total and shipping costs by credit card on the Website.
As soon as the payment has been made and confirmed, an order payment confirmation page appears. This page contains a summary of the order.
At the same time, an order confirmation email is sent to the Customer’s email address within a maximum of 24 hours from the time the order is confirmed. The Customer can track the status of their order via their Customer Account.
La Poste reserves the right to block an order, particularly in the event of suspected or confirmed fraud (compromised authorization, etc.), under the conditions set forth in Article 16 “Termination—Breach” of these Terms and Conditions. In such cases, the Customer will be notified of the reasons for the block via email sent to the Customer’s email address within a maximum of 72 hours from the time the order is blocked, and the Customer will have the opportunity to contest La Poste’s decision.
Electronic invoices are made available to the Customer in PDF format in their Customer Portal. For more information on electronic invoices, the Customer may consult the “Online Help” section accessible on the Website. The Customer’s account will be charged only once for the corresponding amount:
If applicable, the order confirmed by the Customer will be considered final only once the secure payment processing center has approved the transaction.
5.2 Product Prices - Taxes and Customs Duties
5.2.1 Product Prices
Product prices are available on the Website. Prices are listed in euros. Prices are subject to change at any time. Price changes will not apply to Product orders confirmed before the effective date of such price changes.
La Poste also reserves the right to offer preferential rates. These benefits will be presented on the Website or communicated to Customers by any other means. These benefits and preferential offers may be subject to terms and conditions, which will be displayed on the Website or communicated to Customers by any other means.
The applicable prices are those in effect at the time the order is confirmed. Prices are listed inclusive of all taxes for Products subject to VAT and exclusive of taxes for Products not subject to VAT. The prices displayed for Products do not include shipping costs, which vary depending on the destination.
The total amount due by the Customer is indicated at each step of the purchase process, in the shopping cart summary, as well as on the order confirmation page.
For all Products shipped within the European Union, the applicable VAT rate is that in effect in the Customer’s country. For all Products shipped outside the European Union, the price will be displayed exclusive of taxes in the shopping cart and on the invoice.
The Customer is solely responsible for paying any costs, surcharges, and bank fees associated with the payment made by the Customer on the Website.
Customs duties, other local taxes, import duties, or government taxes may be applicable. These will be the Customer’s responsibility as indicated below.
5.2.2 Taxes, Customs Duties, and Other Fees
The Products will be considered delivered once they have been handed over upon signature.
Duties and taxes of any kind may bebe applied at the discretion of the customs authorities of the destination country. It is the responsibility of the recipient of the goods to check with the relevant authorities regarding the nature and amount of duties and taxes that will be due upon receipt of the Products.
If the Products must be returned:
- it is the Customer’s responsibility to contact the customs authorities and the postal operator in the destination country to inquire about the procedures for reimbursement of these charges;
- The Customer must also complete the customs formalities specified in Article 12 below so that the shipment is not considered a new imported shipment. Otherwise, La Poste will be liable for customs duties, for which it will request reimbursement from the Customer.
5.3 Payment Terms for Products on the Website
Payment in euros on the Website may only be made by credit card.
La Poste reserves the right to modify the payment methods offered on the Website at any time and without prior notice.
The accepted credit cards are listed on the Website.
Banking information is stored in accordance with applicable legal provisions. For any payment by credit card, the Customer warrants that he or she is the cardholder or has the cardholder’s express authorization to pay for the purchase. Any fraudulent use of a credit card will result in the termination of the Account under the conditions detailed in Article 16 of these Terms.
Banks may implement certain security measures to secure payment for the order, such as “3D Secure” technology. This secure payment process will be implemented in certain cases depending on, for example, the payment amount.
ARTICLE 6 SHIPPING AND DELIVERY
La Poste offers the Customer a tracked shipping option for international deliveries. The total cost of shipping the Products and the delivery times are indicated to the Customer when the order is placed.
Shipping fees are determined according to the terms specified in the attached table.

The Customer will receive the ordered Products within a maximum of thirty (30) days from the date the order is placed on the Website.
Delivery times do not include any potential delays caused by customs authorities. In the event of high demand, the Website may extend these delivery times to ensure the quality and security of shipments. La Poste will notify the Customer, by sending an email to the Customer’s email address, of any delivery delay as soon as possible after becoming aware of the delay.

Package tracking:
The order will be shipped with tracking available via the Website or the carrier’s website. Once the package has been prepared and shipped, a shipping confirmation email will be sent to the Customer.
The Customer will also receive a tracking number and a hyperlink allowing them to track their package. It is possible to track the main stages of the package’s journey.
La Poste has an obligation of means to provide tracking.
Package tracking is available until the package leaves French territory (point of shipment) for all destinations. For certain destinations, tracking is available until delivery: more information is available at International Services | Colissimo (laposte.fr) .
All packages shipped by La Poste are subject to the air and/or maritime security screening rules established by airlines and shipping companies. These regulations may require the package to be opened. Furthermore, a package may be refused for transport by air, sea, or road—particularly due to its contents—and may therefore be returned to La Poste, for which La Poste shall not be held liable.
In any case, screening will be conducted in accordance with and to the extent necessary for theenforcement of applicable laws and regulations. The package will be delivered to the address provided by the Customer upon signature by the person receiving the package, indicating acceptance, or according to any other delivery method used by foreign partners. In the absence of the Customer or any other person able to accept delivery of the item, the package will be made available under the conditions defined by the foreign partners.
The signature recorded upon delivery, as well as a reproduction of that signature, constitutes proof of the package’s delivery.
ARTICLE 7 LIABILITY OF THE PARTIES
7.1 Liability of La Poste
- Regarding the Website
La Poste makes no warranty as to the ability of the Website and/or the Products to meet the Customer’s specific expectations or needs, particularly given that the Products are sold for the purpose of generating revenue. Similarly, La Poste cannot guarantee the absence of errors or other malfunctions when using the Website or the Products. La Poste cannot under any circumstances be held liable for the reliability of data transmission, access times, or any restrictions on access to the Internet or networks connected to it.
La Poste cannot be held liable in the event of an interruption in the networks providing access to the Website, or the total or partial unavailability of the Website resulting, in particular, from thetelecommunications provider, in the event of transmission errors or issues related to transmission security, or in the event of a failure of the Customer’s receiving equipment or Internet access. La Poste reserves the right to temporarily suspend all or part of the Site for reasons related to the security of the Site or the Customer, or for reasons related to a Customer’s failure to comply with the obligations set forth herein.
La Poste shall not be held liable for thefraudulent use by a third party of the Customer’s Username and Password, which are confidential.
- Regarding Product Orders
Subject to the express provisions below regarding compensation to the Customer, La Poste is liable only for direct damages resulting from its own breaches. La Poste shall in no event be liable for damages such as: financial losses, loss of profits, damage to brand reputation, loss of computer programs suffered by the Customer, loss of enjoyment, or emotional distress, all such damages being, by express agreement, deemed to be indirect damages. La Poste shall not be liable and shall not be considered to have breached its obligations in the event of non-performance of all or part of its obligations resulting from a force majeure event (e.g., flood, fire, requisition by a public authority, etc.) In such a case, La Poste will notify the Customer and work with the Customer to determine the measures to be taken to remedy the situation under the conditions set forth in the “Force Majeure” section.
In the event of a breach attributable to La Poste in the performance of its obligations, La Poste will refund the amount paid by the Customer for the delivery of the Products by La Poste. In any event, La Poste shall not be liable when the damage results from:
- an event of force majeure, such as: flooding, fire, requisition by a public authority, etc.
- an event beyond La Poste’s control (such as transport bans, the detention of goods by customs authorities, exceptional circumstances, etc.)
In the event of loss or damage to the package, the Customer must file a claim with La Poste under the conditions set forth in Article 15 below.
In the event of loss or damage to the package confirmed by foreign partners or by La Poste’sinformation system, and following an investigation by customer service, La Poste will compensate the Customer under the terms defined in this article of the Terms and Conditions.
To determine whether damage has occurred, La Poste will use all information in its possession as well as that provided by the Customer.
7.2 Customer Liability
7.2.1 The Customer is solely responsible for:
- installing, maintaining, and verifying the technical configuration necessary to connect to the Website and purchase the Products;
- for the use they make of the Products and the Website, it being understood that such use must comply with fair commercial practices, applicable law, public order, and public decency;
- for the proper functioning of their equipment and their Internet access. It is the Customer’s responsibility to take all appropriate measures to protect their own data, computer systems, and/or software from infection by any viruses.
The Customer is liable for any damages thatthey may cause to La Poste as a result of failure to comply with these Terms and Conditions.
The Customer indemnifies La Poste against any claim or action by a third party alleging a violation of that third party’s rights resulting from the Customer’s use of the Website.
The Customer acknowledges that any use of the Website and/or the Products, and in particular any access to their Account using their login credentials (username and password), is presumed to have been carried out by the Customer and will be attributed to them, unless the Customer provides proof to the contrary.
The Customer agrees not to modify, attempt to modify, or interfere with the Website in any way whatsoever, and not to use any software or computer program for the purpose of accessing or making available protected or non-publicly available content. It is also prohibited to create a derivative work or website based on all or part of the Website. The Customeragrees to notify La Poste immediately, by any means, of any error, fault, or irregularity they may notice while using the Website and/or the Products, as soon as they become aware of it.
In the event of the Customer’s failure to comply with these Terms and Conditions, access to the Website and the Products will be automatically blocked, without prejudice to any legal proceedings that may be initiated by La Poste and any damagesthat may be claimed. The Customer will be informed of the reasons for the blocking of their access to the Website and the Products via an email sent to their email address within a maximum of 48 hours from the time their access to the Website and the Products is blocked. The Customer will have the opportunity to contest La Poste’s decision La Poste.
In response to a security alert (antivirus scan, etc.), at the request of an authority (administrative, judicial, or any other authorized authority), or in response to an alert from another user/customer, La Poste reserves the right, where applicable:
- to retain, for evidentiary purposes, any information that does not comply with the rules set forth herein;
- to retain, for evidentiary purposes, any logs, connection records, or personal or non-personal data proving that the behavior or actions in question are attributable to the Customer;
- to modify, deny, and/or revoke access to any information that does not comply with the rules set forth herein;
- to apply the provisions of Section 16, “Termination—Breach—Account Closure.”
7.2.2 Compliance with National and International Regulations
7.2.2.1 Certain Products are subject to territorial delivery restrictions.
Before placing an order, the Customer is required to ensure that the ordered Products are not items whose import or transport is prohibited in the destination country.
The Customer is required to obtain this information directly from customs authorities. An indicative list of import or transport prohibitions applicable in certain countries is also available on the Website.
7.2.2.2 The Customer agrees to comply with national and international regulations, particularly those relating to export controls.
In particular, the Customer warrants that their order complies with the following regulations: (i) national and international regulations concerning dual-use goods, or restricting (goods subject to export licensing) or prohibiting the export of certain goods; (ii) national and international regulations relating to anti-corruption, (iii) any restrictions or embargoes imposed by United Nations sanctions regimes or by any other regional or national regime, (iv) national and international regulations regarding the fight against terrorism and money laundering.
The Customer is informed and agrees that their personal data will be verified to ensure that such data does not appear on any national or international sanctions lists, including the European Union’s and the United Nations’ sanctions lists. The Customer agrees to inform the recipient if the order is placed by the Customer on behalf of another party. If shipments excluded under this section are identified as such by La Poste, La Poste reserves the right to (i) suspend or halt delivery, and (ii) provide any required information to the competent authorities and follow any procedures required by said authorities, including the destruction of the shipments at the Customer’s expense, without La Poste incurring any liability as a result.
ARTICLE 8 INTELLECTUAL PROPERTY RIGHTS AND INFRINGEMENT
8.1 The Website and the Products
The Website and the Products are protected by intellectual property rights and/or other rights, which La Poste owns or has been authorized to use.
The general structure, the text, whether animated or not, and all elements comprising the Site are protected and governed by French and international copyright and intellectual property laws. All reproduction rights are reserved, including for downloadable documents and iconographic and photographic representations.
Under no circumstances may the Customer store (excluding login sessions, if applicable), reproduce, display, modify, transmit, publish, adapt on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, any elements of the Website and/or the Products without the prior written authorization of La Poste. Any unauthorized extraction and/or reuse of one or more databases taken, copied, or created from the content of the Website and/or the Products, whether directly or indirectly, is subject to civil and criminal penalties.
8.2 Trademarks
La Poste is a registered trademark. Any use whatsoever of the trademarks and logos on the Website, including, but not limited to, the trademarks and trade names owned by La Poste and/or its partners, is prohibited without theauthorization of the rights holders. Any reproduction or representation, by any means whatsoever, in whole or in part, of the Website or any of its components, without the express prior authorization of La Poste or its partners, is strictly prohibited and would constitute an infringement.
8.3 Counterfeiting of Postage Stamps
Any reproduction or modification of postage stamps without La Poste’s authorization constitutes counterfeiting.
“Reproduction” means the exact or similar reproduction (including, but not limited to, photocopies and unauthorized prints) of postage stamps.
The use of counterfeit postage stamps may result in La Poste charging the sender an amount equal to the price of the counterfeit postage stamps according to the current rate, plus a penalty of 10% of that amount.
La Poste reserves the right to pursue all legal remedies available to it in connection with counterfeiting and to seek compensation for any damages suffered.
The counterfeiting or forgery of postage stamps is punishable by five years’ imprisonment and a fine of 75,000 euros in accordance with Article 443-2 of the Penal Code.
ARTICLE 9 PERSONAL
All Customers may be required to provide personal data, particularly during registration, notably for the use of the Website and/or the purchase of Products. ARTICLE 11 RIGHT OF WITHDRAWAL
The provisions of this Article 11 apply subject to any more favorable provisions that may apply to the Customer under the mandatory legal provisions of their country of residence.
11.1 Scope of Application
In accordance with Article L. 221-18 et seq. of the French Consumer Code, the Customer hasa right of withdrawal of 14 calendar days for Products sold on the Website, except where otherwise provided by law and as indicated on the Product pages. This withdrawal period begins on the date of receipt of the Product.
11.2for Exercising the Right of Withdrawal
Customers may exercise their right of withdrawal:
- by clicking directly on the “Cancel Order” button available in their customer account under the “Orders” section, which will direct them to the procedure for notifying their cancellation.-
- or by sending a message via the following page www.francestampphilatelystore.laposte.fr/contact, using either the withdrawal form attached to the Terms and Conditions below (see Appendix 1: Withdrawal Form) or an unambiguous statement expressing their intention to withdraw, specifying the order number, the date the order was received, and a description of the Products to be returned.
Upon exercise of the right of withdrawal, La Poste will send an acknowledgment of receipt of the request to withdraw from the purchase of the Products, along with instructions on how to return the Products.
11.3 Refund
In the event of order cancellation, La Poste will refund all payments received, including shipping costs (with the exception of additional costs resulting from the Customer’s choice of a delivery method other than the standard delivery method offered by La Poste) no later than fourteen (14) calendar days from the date La Poste receives the Products subject to the cancellation.
La Poste will issue the refund using the same payment method the Customer used for the initial transaction, unless the Customer expressly agrees to a different method; in any case, this refund will not incur any fees. It is the Customer’s responsibility to return the Products for which they have exercised their right of withdrawal in accordance with the conditions specified by La Poste.
Regarding the cost of returning Products:
- ; For the following countries click here, La Poste will send the Customer a prepaid Colissimo label to their email address, and the Customer will use this label for the Products they wish to return to La Poste. This label is to be used at a pickup location;
- ; For other countries, the Customer must return the Products via Colissimo (or, failing that, by an equivalent method), and La Poste will reimburse the Customer for the return shipping costs. If the Customer wishes to use a more expensive return method, the Customer will be responsible for the difference in price.
ARTICLE 12 CUSTOMS
12.1 Customs formalities handled by La Poste when shipping Products to the Customer outside the European Union
La Poste undertakes to complete, whenever necessary, all customs and/or tax formalities to which it may be subject as a result of the shipment, in accordance with the Acts of the Universal Postal Union. Thus, postal shipments must always be accompanied by a customs declaration (form CN23). The sender (La Poste) must, in particular:
- provide a precise and complete description of the shipment’s contents, even if it is a gift or a sample
- include two copies of a commercial or pro forma invoice, depending on the nature of the postal shipment
- enter the information on the customs declaration in English for non-French-speaking destinations (including China, Korea, and Brazil).
The Customer is informed that their personal data and the information appearing on the customs declaration will be transmitted electronically by La Poste to customs authorities and La Poste’s international partners.
12.2 Customs formalities when the Customer returns Products to La Poste
If the Customer wishes to return a postal shipment to La Poste, they must ensure that they have checked the box for the return of goods on the CN 23 form attached to the postal shipment they received. Otherwise, and as indicated in Article 5.2.2 above, the shipment will be considered by French Customs as an import of goods for which La Poste will be liable for customs duties and taxes, the reimbursement of which it will request from the Customer.
ARTICLE 13 LEGAL WARRANTIES
The provisions of this Article 13 apply subject to any more favorable provisions that may apply to the Customer under the mandatory legal provisions of their country of residence.
The Statutory Warranty of Conformity for Products
The consumer hasa period of two years from the delivery of the goods to invoke the statutory warranty of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it arose. When the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory warranty applies to such digital content or digital service throughout the entire period of supply provided for in the contract. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it first appeared.
The statutory warranty of conformity requires the seller, where applicable, to provide the updates necessary to maintain the conformity of the goods. The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to the consumer. If the goods are repaired under the statutory warranty of conformity, the consumer is entitled to a six-month extension of the original warranty period. If the consumer requests repair of the product but the seller insists on replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement. The consumer may obtain a reduction in the purchase price while retaining the item or terminate the contract by obtaining a full refund in exchange for returning the item, if:
1. The seller refuses to repair or replace the item;
2. The item is repaired or replaced after a delay of thirty days;
3. The repair or replacement of the item causes significant inconvenience to the consumer, particularly when the consumer is permanently responsible for the costs of returning or picking up the non-conforming item, or ifthe consumer bears the costs of installing the repaired or replacement item;
4. The nonconformity of the item persists despite the seller’s unsuccessful attempts to bring the item into conformity. The consumer is also entitled to a price reduction or to rescind the contract if the defect is so serious that it justifies an immediate price reduction or termination of the contract. In this case, the consumer is not required to first request repair or replacement of the item. Any period during which the item is out of service for repair or replacement suspends the warranty that was in effect until the delivery of the repaired item. The rights mentioned above result from the application of Articles L. 217-1 through L. 217-32 of the Consumer Code.
The Statutory Warranty Against Hidden Defects
The Customer has a period of two years to invoke the statutory warranty against hidden defects, starting from the date the defects are discovered, subject to a limit of two years from the discovery of the defect in question and twenty years from the date the Products were ordered. The Customer must provide proof that the defect existed prior to delivery of the Product and that the defect was not visible at the time of delivery. If the existence of the hidden defect is confirmed, the Customer may choose between:
∙ a full refund of the price of the returned product;
∙ a refund of part of the price of the product if the Customer keeps the product.
ARTICLE 14 FORCE MAJEURE
A Party shall not be held liable fora delay in the performance of its obligations or a failure to perform its obligations under the Contract when the circumstances giving rise thereto fall within the scope of force majeure as defined by Article 1218 of the Civil Code and case law. Events beyond the control of the Parties and which they could not reasonably have been expected to foresee—to the extent that their occurrence makes the performance of their obligations more difficult or more costly—are considered cases of force majeure with respect to the Parties’ obligations. This shall apply, in particular, to cases recognized by case law.
The Party invoking force majeure must notify the other Party by any means as soon asit becomes aware of it.
If the impediment is temporary, force majeure shall suspend the performance of the relevant contractual obligations for the duration of the force majeure event.
If the suspension lasts more than thirty (30) calendar days, either Party may terminate this Agreement by registered letter with acknowledgment of receipt addressed to the other Party. The Party prevented from performing its obligations shall endeavor to mitigate or eliminate the effects thereof as soon as possible by any reasonably appropriate means. If the impediment is permanent, these general terms and conditions shall be terminated ipso jure and the Parties shall be released from their obligations under the conditions set forth in Articles 1351 and 1351-1 of the French Civil Code.
ARTICLE 15 HANDLING OF COMPLAINTS
15.1 Customer Service
Several channels are available to the Customer on the Website so that they may file a complaint with La Poste or obtain information:

In the event of a claim regarding damage to a postal shipment, the customer must provide La Poste with a photo of the package before opening it, as well as a photo of the damaged products.
In the event of a claim regarding non-receipt of the package, the customer must provide La Poste with a written sworn statement specifying that the Products were not received, along with a copy of their ID.
15.2 Filing a Complaint with the Consumer Ombudsman
Unresolved disputes may be referred to the La Poste Group’s Consumer Ombudsman if the response from Customer Service does not satisfy the Customer or if the Customer has not received a response within two (2) months after submitting their complaint to Customer Service. The Customer/User must file a complaint with the Ombudsman within a maximum of one year from the date of the first written complaint submitted to La Poste.
The Customer/User must include the following information with their complaint:
1. Customer/User identification: last name, first name, status (individual or legal entity; if a legal entity, company name), mailing address, phone number, and email address, if applicable;
2.Details of the dispute and the circumstances surrounding the events that gave rise to the dispute;
3. Purpose of the request to the Ombudsman (in the case of a claim for compensation, the specific amount requested and justified) and arguments (facts, contractual or legal provisions, etc.) in support of this request, along with a copy of the documents substantiating the filing of an initial written complaint with La Poste dated more than two months ago and copies of La Poste’s responses;
4.Evidence supporting the request (including proof of order and invoice) and in particular:
In the event of damage, a photo of the package before opening as well as a photo of the damaged Products;
In the event of non-receipt of the package, a written sworn statement confirming that the Products were not received, along with a copy of the signatory’s identification document.
The shipping costs for submitting the claim are and remain the responsibility of the Customer/User.
Once the case file is received, the Mediator has 3 weeks to notify the Client/User whether the mediation is admissible or not. Please note that inadmissible requests are not returned.
Mediation begins on the date of notification of admissibility.
ARTICLE 16 TERMINATION – BREACH – ACCOUNT CLOSURE
16.1 In the event of a breach by the customer - Measures Taken by La Poste
In the event of a breach by the Customer, and in particular in the event of fraud, La Poste reserves the right to immediately take the necessary measures to remedy the identified breaches, such as, in particular:
- suspension of the account in question, which may result in the suspension of certain purchases made on the Website using the Customer’s account. This suspension will be lifted once the total amount of the fraud, plus a 10% penalty, has been paid;
- or even permanently blocking the Customer’s account if the total amount of the fraud, plus a 10% penalty, is not paid. If the Customer’s account is blocked, the Customer will be unable to make certain purchases on the Website using their account;
- send the Customer an adjustment invoice for an amount equal to the amount of the fraud, plus a 10% penalty and duly justified administrative fees; La Poste will notify the Customer by any means (including email), specifically regarding the amount of the fraud owed to La Poste and the terms of settlement. If the Customer’s account is suspended or blocked, the Customer may:
- view their account history.
In general, La Poste reserves the right to unilaterally terminate the Customer’s right to access and use the account in the event of a serious and/or repeated breach by the Customer of any of their obligations, including those set forth in these General Terms and Conditions of Sale, and to pursue any available legal action to seek compensation for damages suffered as a result of the Customer’s breach.

16.2 Account Closure at the Initiative of the Customer or La Poste
The procedures for closing the Account by the Customer are available on the Website https://francestampphilatelystore.laposte.fr in the 'Help / How do I delete my account?' section
La Poste may close the Customer’s account in the event of prolonged inactivity after notifying the Customer and if the Customer fails to respond to the notification within a reasonable period of time.
ARTICLE 17 HYPERLINKS
17.1 The Site may contain hyperlinks to other websites over which La Poste has no control. Despite the checks carried out before any hyperlink is posted on its site, La Poste disclaims all liability for the content of these sites and any updates that may be made to them.
17.2 La Poste authorizes the creation of hyperlinks to any page or document on its website, provided that such links are not created for commercial or advertising purposes. Such links may only be established on the condition that the authors of the link have first notified the site’s webmaster. Of course, this authorization does not apply to websites that publish information of an illegal, violent, controversial, pornographic, or xenophobic nature, or that may offend the sensibilities of the general public. Finally, La Poste reserves the right to have any hyperlink pointing to its Site removed at any time if it deems that the link does not comply with its editorial policy.
ARTICLE 18 MODIFICATION OF THE TERMS OF SALE
In the event of a change in legal or factual circumstances, new terms and conditions of sale will be established. The Customer will be notified by any means of the amended terms and conditions of sale and must then accept them by checking a box on the Site in order to continue making new purchases on the Site.
ARTICLE 19 GOVERNING LAW
These General Terms and Conditions of Sale are governed by French law, without prejudice to the application of legal provisions in the country of destination of the postal shipment that are more favorable to the Customer.
These General Terms and Conditions of Sale are written in English. In the event that they are translated into one or more languages, only the English text shall be deemed authentic in the event of a dispute.
In the event of a dispute, and in the absence of an amicable agreement between the Parties, the dispute shall be submitted to the competent French courts within the jurisdiction of the Court of Appeal of [Paris], or to the competent courts in accordance with the mandatory rules applicable to the Customer under the consumer law of their country of residence.
